This Collection Notice sets out details of how and why Formula IQ Pty Ltd trading as Pear Beauty ACN 689 102 930 (referred to as ‘Pear Beauty’, ‘us’, ‘we’, ‘our’) collects personal information. In this Collection Notice, ‘you’ refers to any individual about whom we collect personal information from in Australia.

What is personal information?

In Australia, ‘personal information’ is any information or an opinion about an identified individual, or an individual who is reasonably identifiable.

How and why we collect personal information

Pear Beauty collects personal information to register and manage your member account, take your orders and deliver your orders.

Personal information we will typically collect includes your name, date of birth, gender, contact details, including residential and delivery addresses, login information (including registration passwords and usernames) and other user IDs, information about your browsing behaviours, your skin profile and preferences (such as skin type and concerns), orders and purchases, including payment card and transaction details, products you view, save or scan, product ratings and likes you give to products, inferred information about you (such as predicted skin needs and product affinities), personalised recommendations we generate from your activity, and feedback provided about our products and services. We also collect general site traffic data.

We will collect this information when you use our services or interact with us, either electronically (e.g. via websites (including through technologies, such as cookies), apps, social media, chats, telephone, emails and/or SMS) or telephone. We may also collect personal information about you from third parties where you have agreed with them that your information may be disclosed with us. When using the product scan function we collect photos, videos, media, product details, among others. This media will be stored and used to identify products and improve product matching. Biometric information from these scans (such as face or skin close ups) is not used for biometric identification.

Information we collect via apps on mobile devices or smart devices (e.g. smart watches) includes the device type and model and version of your browser and, your device ID and other device metrics, as allowed by your device permissions. We may also collect metadata including social media content (including tags, handles and other social media profile information) when you create your Pear Beauty account and authenticate with a third party social media service.

We also collect information to process job applications if you apply for a job with us. The personal information that may be collected about you for these purposes include your name, contact details, employment and training history and other information included as part of your application or resume. Information may also be obtained from psychological or aptitude tests and from referees.

Typically we will use your personal information to:

1. provide you with information that you have requested;
2. verify your identity;
3. contact you;
4. process orders you make through our apps;
5. add you to our mailing list;
6. send you marketing materials;
7. promote our products and services, including via direct marketing or tailored advertising;
8. deliver to you the products that you have ordered and provide you with customer service following these orders;
9. improve the app experience of our visitors;
10. provide personalised experience and personalised recommendations;
11. provide products or services to you or to receive products or services from you;

We are not required by law to collect any personal information you may provide to us when seeking access to our products or services.

Consequences if personal information is not collected

The main consequence of us not collecting your personal information is that we may not be able to provide products, services or information to you, or be able to provide them to the same standard as if we had the information requested.

Depending on how you deal with us, it’s possible we may need to collect other types of personal information necessary to respond to your needs. Without this information, we may not be able to do so.

Sharing personal information

We may share personal information to our service providers or between our affiliates. Some personal information may be transferred to such parties in countries outside of Australia in the course of our business.

We will not supply, sell or in any other knowing way, make available your personal information to other parties other than in the circumstances outlined above, unless you authorise us to do so.

Pear Beauty participates in affiliate marketing programs. This means the Pear app and our website may contain links to third-party retailers and brands. When you click one of those links and/or make a purchase, we may receive a commission or other fee from the retailer or affiliate network. This comes at no additional cost to you — you never pay more because you used one of our links.

Affiliate relationships do not influence the ingredient analyses, product matching or recommendations the Service generates. Those are based on your skin profile, your inputs and our editorial and scientific approach — not on whether a product earns us a commission. The presence of an affiliate link does not constitute an endorsement, sponsorship or guarantee of any product, brand or retailer.
